Cancellation and Refund Policy

At Clear Title & Appraisal Co., we strive to provide exceptional service, but we understand that circumstances may require cancellation or refund requests. This Cancellation and Refund Policy (“Policy”) outlines the terms for canceling Services and obtaining refunds. This Policy is part of our Terms and Conditions and applies to all orders placed through https://clear2close.us/.

This Policy applies to Services including title commitments, appraisals, title insurance, and related real estate services. Due to the nature of these professional services, many are non-refundable once commenced. All cancellations and refunds are subject to Texas law, including the Texas Business and Commerce Code Chapter 601 for certain consumer transactions.

  1. Cancellations

Pre-Service Cancellations

  • You may cancel an order for Services before we begin performance (e.g., before starting a title search or appraisal) by notifying us in writing via email or through your Digital Docs portal.
  • Cancellations must be received within 24 hours of order placement to avoid any charges. If we have incurred costs (e.g., preliminary research), a cancellation fee of up to 25% of the order total may apply.
  • For door-to-door or off-site solicitations exceeding $25 in value (or $100 for real estate), Texas law provides a 3-business-day right to cancel from the date of the transaction. We will provide the required Notice of Cancellation form if applicable.

During-Service Cancellations

  • Once we have commenced performance (e.g., initiated title search, conducted appraisal site visit, or issued preliminary documents), cancellations are not permitted, and no refunds will be issued, except as required by law.
  • Appraisal revisions or custom workflows requested by you may incur additional fees and are non-cancelable once started.

Subscription or Ongoing Services

  • If applicable (e.g., Digital Docs portal access), subscriptions may be cancelled at any time via your account settings, effective at the end of the current billing cycle. No partial refunds for ongoing periods.

Eligibility for Refunds

  • Full Refunds: Available only for pre-service cancellations within the timelines above, minus any applicable fees. We process refunds within 10 business days of approval.
  • Partial Refunds: In cases where partial performance has occurred (e.g., incomplete appraisal due to our error), we may offer a partial refund at our discretion, typically pro-rated based on work completed.
  • Non-Refundable Services: Title insurance premiums, completed appraisals, and escrow fees are non-refundable once issued or performed, as they represent professional opinions and commitments. Per Texas regulations, title insurance is a one-time premium for ongoing coverage and not subject to refunds.
  • Legal Requirements: If a transaction qualifies under Texas Business and Commerce Code §601 (e.g., consumer transactions over $25 solicited away from our place of business), you have a 3-business-day cancellation right with full refund, excluding any goods or services already provided. We will comply with all statutory obligations, including returning any payments within 10 business days.
  • Errors or Dissatisfaction: Refunds for errors on our part (e.g., inaccurate title search due to our negligence) will be provided at our discretion, potentially limited to re-performance of the Service at no extra cost. We do not refund for dissatisfaction with professional opinions, such as appraisal values.

Refund Process

  2. We will review within 5 business days and notify you of approval/denial.
  3. Approved refunds will be issued to the original payment method within 10 business days.
  4. Refunds do not include shipping, handling, or tax fees unless required by law.

No Refunds for Certain Cases

  • Services completed as ordered.
  • Digital deliverables (e.g., PDFs of commitments or reports) once downloaded.
  • Orders canceled after the 24-hour window without valid reason.
  • Any disputes related to real estate transaction outcomes, as these are governed by separate contracts.
  1. Force Majeure

We are not liable for delays or failures in performance due to events beyond our control, such as natural disasters, strikes, or government actions. Such events may affect cancellation or refund timelines.
